In the ongoing case of Texas Top Cop Shop, Inc. v. Garland, No. 4:24-CV-478, 2024 WL 5049220 (E.D. Tex. Dec. 5, 2024), the U.S. Court of Appeals for the Fifth Circuit has issued a significant ruling. On 26 December 2024, the court overturned the government’s emergency motion for a stay of the preliminary injunction, thereby reinstating a nationwide injunction against the enforcement of the Corporate Transparency Act’s (CTA) Beneficial Ownership Information (BOI) reporting requirements.
The reinstatement means that, for the time being, the BOI reporting deadline remains temporarily suspended until further proceedings.
